Welcome to TravelEasy. These Terms of Service ("Terms") govern your access to and use of the TravelEasy website at www.traveleasylife.com (the "Platform"), operated by TravelEasy ("we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms.
⚠️ Platform Role Disclaimer
TravelEasy operates exclusively as an intermediary platform that connects travelers with independent travel agencies. We do not provide travel services ourselves. All bookings, payments, cancellations, refunds, and service delivery are handled directly between you (the traveler) and the travel agency. TravelEasy is not a party to any agreement between travelers and agencies and assumes no liability for the services provided by agencies.
1. Definitions
- "Platform" refers to the TravelEasy website, mobile applications, and all related services.
- "User" or "You" refers to any person who accesses or uses the Platform, whether as a Traveler or an Agency.
- "Traveler" refers to users who browse, inquire about, or book travel experiences through the Platform.
- "Agency" refers to travel agencies or service providers who list their offerings on the Platform.
- "Content" refers to text, images, reviews, listings, and all other materials on the Platform.
2. Acceptance of Terms
By creating an account, browsing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
3. Our Role as Intermediary
3.1 What We Do
- Provide a platform for travel agencies to showcase their trips, events, and services
- Enable travelers to discover, compare, and connect with agencies
- Offer verification badges to agencies that meet our quality standards
- Provide communication tools to facilitate interaction between travelers and agencies
- Publish travel content, guides, and blog articles
3.2 What We Do NOT Do
- We do not provide travel services directly
- We do not process payments for bookings between travelers and agencies
- We do not guarantee the quality, safety, or legality of any agency's services
- We do not act as an agent, broker, or insurer for any party
- We do not mediate disputes between travelers and agencies (though we may assist voluntarily)
3.3 Your Relationship with Agencies
When you book or engage with a travel agency through our Platform, you enter into a direct agreement with that agency. All terms of service, pricing, cancellation policies, payment methods, and liability are determined by the agency. We strongly recommend reviewing the agency's own terms before making any booking.
4. User Accounts
4.1 Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account.
4.2 Account Types
- Traveler accounts: For individuals browsing and booking travel experiences
- Agency accounts: For travel businesses listing their services on the Platform
4.3 Account Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may delete your account at any time by contacting us.
5. Agency Obligations
If you register as an Agency, you agree to:
- Provide accurate and truthful information about your business, services, and pricing
- Hold all necessary licenses, permits, and insurance required by applicable law
- Fulfill all bookings and commitments made through the Platform
- Handle all payments, refunds, and cancellations directly with travelers
- Comply with all applicable local, national, and international laws
- Not mislead travelers regarding the nature, quality, or availability of your services
- Respond to traveler inquiries in a timely and professional manner
6. Traveler Obligations
As a Traveler, you agree to:
- Use the Platform only for lawful purposes
- Verify the details of any booking directly with the agency before committing
- Understand that TravelEasy is not responsible for the services provided by agencies
- Communicate respectfully with agencies and other users
- Not post false reviews or misleading information
7. Verified Badges
Some agencies on our Platform display a "Verified" badge. This badge indicates that the agency has undergone a basic verification process, which may include identity confirmation and business documentation review. However:
- A Verified badge does not constitute an endorsement or guarantee of service quality
- We do not guarantee the accuracy of any agency's claims
- Travelers should exercise their own due diligence before booking
8. Content and Intellectual Property
8.1 Our Content
All content on the Platform (design, text, graphics, logos, software) is owned by or licensed to TravelEasy and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
8.2 User-Generated Content
By posting content (reviews, comments, images) on the Platform, you grant TravelEasy a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Platform. You retain ownership of your content but are responsible for ensuring it does not violate any third-party rights.
9. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Post fraudulent, defamatory, or misleading content
- Attempt to gain unauthorized access to the Platform or other users' accounts
- Use automated means (bots, scrapers) to access the Platform without permission
- Interfere with the Platform's functionality or security
- Use the Platform to spam or send unsolicited communications
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: TravelEasy, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from (a) your use of or inability to use the Platform; (b) any services provided by agencies listed on the Platform; (c) any transactions between you and any agency; (d) any loss of data, profits, or goodwill; or (e) any unauthorized access to your account or information.
TravelEasy's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you have paid to TravelEasy (not to any agency) in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless TravelEasy and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
12. Dispute Resolution
12.1 Between Travelers and Agencies
Disputes between travelers and agencies should be resolved directly between the parties. While TravelEasy may voluntarily offer to facilitate communication, we are under no obligation to mediate, arbitrate, or resolve any disputes.
12.2 Between Users and TravelEasy
Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of the Kingdom of Morocco. You agree to first attempt to resolve any dispute informally by contacting us. If the dispute cannot be resolved informally, it shall be submitted to the competent courts of Marrakech, Morocco.
13. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Platform or email. Your continued use of the Platform after modifications constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
